Updated SAFETRAC Trade Practices Program now available

The recent amendments to the Trade Practices Act are now confirmed and have come into effect. [Effective 1st January 2007]

The SAFETRAC Trade Practices program has been comprehensively updated.

In summary, the changes to the Trade Practices Act are significant and include:

• increased penalties for anti-competitive conduct
• the ability to create a defense to the absolute prohibition on price fixing, market sharing and exclusionary provisions where the conduct is for the purpose of a joint venture and there is no substantial lessening of competition
• the removal of the absolute prohibition on third line forcing in relation to interrelated companies
• amended ACCC powers to enter premises
